Charles Taylor in A Secular Age describes the modern secular age as one in which ‘the eclipse of all goals beyond human flourishing … falls within the range of an imaginable life for masses of people’. This article reflects on his historico-analytic investigation of the emergence of modern secularity and his account of how it shapes the current conditions of belief. Taylor challenges the widespread presumption against belief mainly on ethical considerations, especially what counts as human fulfilment. The article argues (...) that he fails to deal adequately with epistemic considerations bearing on belief and unbelief. Furthermore, his argument is weakened by a surprising absence of attention to the primary account of human fulfilment in Greek philosophy as a central element in the Christian tradition. (shrink)

This article considers the major constitutional reforms which have taken place in the United Kingdom during the period of government by the Labour Party, 1997-2010. Within the context of the UK’s unwritten constitution, the article first considers how ‘constitutional’ law can be identified when compared with a written constitution, such as that of the Republic of Lithuania. The article then analyses the major reforms which have taken place since 1997, the political reasons behind them, the processes of reform and their (...) impact on the constitution. The four areas examined—reform of the House of Lords; the enactment of the Human Rights Act 1998; devolution; and the changes to the judiciary in the Constitutional Reform Act 2005—have all had a significant impact on the way in which the UK is governed. The article argues that these are all welcome developments, but that in many cases they are incomplete. In the absence of the likelihood of a future written constitution for the UK, sustained efforts by future governments are needed by to ensure that the reforms fulfil their aim of modernizing the democratic system. Legal frameworks are in place to protect those who lack the capacity to consent to research, such as the Mental Capacity Act in the UK. Assent is sought instead from a proxy, usually a relative. However, the same legislation may, perversely, affect the welfare of those who lack capacity and of others by hindering the process of recruitment into otherwise potentially beneficial research. In addition, the onus of responsibility is moved from those who know most about the study (ie, the (...) scientific community) to those who know less (the proxies). In this paper, we describe the characteristics of a sample at different stages of the recruitment process of an influenza vaccine-based randomised control trial in elderly care home residents (the FEVER study). 62% (602/968) of potential subjects lacked capacity but only 29% (80/277) of those actually randomised. Older age, being female and living in an Elderly Mentally Ill care home were the only variables associated with lacking capacity. Considering this was a study based in a care home setting where the prevalence of dementia approximates 80%, the trial, like many others, was thus significantly biased. We believe that difficulties seeking proxy assent contributed significantly to this problem. Further thought should be given to how assent to enter research for those who lack capacity should be provided, and we suggest avenues for further discussion such as independent risk/benefit expert panels. The difficulties in placing Newman in a philosophical school or in putting some sort of shape on Newman the philosopher stem in part from Newman's (understandable) near failure to guide the reader as to his overt philosophical method. On the other hand, in the many discussions and controversies that occupied Newman throughout his life—whether conducted through letters or more formal writings—there is gathering witness to a consistent philosophical way in Newman. This paper seeks to put some shape on Newman the (...) philosopher by two principal methods. First, by considering some inaccurate or wholly misleading philosophical labels which have been attached to Newman both in his day and in contemporary times. These help, as it were, to shape Newman the philosopher from without. Second, by examining those elements of his writing that have a philosophical cast, and teasing out hints and clues to Newman the philosopher. The paper argues that while Newman can most certainly be thought of as a philosopher, his subtle philosophical way situates him only problematically in any particular philosophical school, though there can in his work be traced connections to particular philosophical programmes, such as, for example, British empiricism. In the postwar years Jean-Paul Sartre set himself the task of writing a book on ethics. His concern was to take up issues raised by his existentialist ontology and to resolve problems in his bleak account of the human situation in Being and Nothingness. "I am searching," he said, "for an ethics for the present time." For several years he prepared background notes, but then put the material aside as too abstract and idealistic, leaving it for publication after his (...) death. Years later he returned to ethics, this time in the hope of developing an account related to the Critique of Dialectical Reason. But once again he left the inquiry incomplete. There was yet a third attempt towards the end of his life when Sartre was blind and weak, a poignant witness to his abiding interest in ethics. This took the form of interviews with Benny Lèvy, which appeared in a controversial publication just before his death. Sartre in Search of an Ethics is a study of each of these stages in his ethical quest, with a focus on the major themes of his existentialist and dialectical ethics in the context of some of his main philosophical and literary writings. Sartre’s memoir Words turns on his mid-life realisation that, although he had abandoned belief in God, he had hitherto based his work on a religious model. From this point God no longer appears as a primary reference in his writings. This is in sharp contrast with the pervasive presence of God in earlier works, especially in his ontology and related reflections on ethics. In ontology Sartre was particularly concerned with the Cartesian idea of the creator God as ens causa sui. (...) Adapting this to his own system, he uses the idea of causa sui to mark the absolute (but non-substantial) existence of for-itself being (consciousness) as separate from the uncreated plenitude of in-itself being. He then argues that the idea of God as a consciousness that founds its own being is an impossible synthesis of the for-itself and the in-itself. The idea nonetheless remains fundamental for consciousness, for desire, which arises in response to lack, ultimately the lack of in-itself being, reflects an original choice that leads to constant striving towards the impossible goal of being God. This theme haunts the ontology from beginning to end. Sartre offers a system to rival Descartes or Leibniz, but adopts a quasi-religious framework of salvation in which, apart from the promise of a possible escape from ontological destiny, human beings are condemned to futility. In ethics he explores the idea of conversion from original choice to an authentic choice of freedom, but fails to break out of the closed framework set by the ontology. (shrink)

Academic health centres have historically treated patients with the most complex of diseases, served as training grounds to teach the next generations of physicians and fostered an innovative environment for research and discovery. The physicians who hold faculty positions at these institutions have long understood how these key academic goals are critical to serve their patient community effectively. Recent healthcare reforms, however, have led many academic health centres to recruit physicians without these same academic expectations and to partner with non-faculty (...) physicians at other health systems. There has been limited transparency in regard to the expertise among the physicians and the academic faculty within these larger entities. Such lack of transparency may lead to confusion among patients regarding the qualifications of who is actually treating them. This could threaten the ethical principles of patient autonomy, benevolence and non-maleficence as patients risk making uninformed decisions that might lead to poorer outcomes. Furthermore, this lack of transparency unjustly devalues the achievements of physician faculty members as well as potentially the university they represent. In this paper, it is suggested that academic health centres have an obligation to foster total transparency regarding what if any role a physician has at a university or medical school when university or other academic monikers are used at a hospital. Despite the lack of invariance problem (the many‐to‐many mapping between acoustics and percepts), human listeners experience phonetic constancy and typically perceive what a speaker intends. Most models of human speech recognition (HSR) have side‐stepped this problem, working with abstract, idealized inputs and deferring the challenge of working with real speech. In contrast, carefully engineered deep learning networks allow robust, real‐world automatic speech recognition (ASR). However, the complexities of deep learning architectures and training regimens make it difficult to use them to (...) provide direct insights into mechanisms that may support HSR. In this brief article, we report preliminary results from a two‐layer network that borrows one element from ASR, long short‐term memory nodes, which provide dynamic memory for a range of temporal spans. This allows the model to learn to map real speech from multiple talkers to semantic targets with high accuracy, with human‐like timecourse of lexical access and phonological competition. Internal representations emerge that resemble phonetically organized responses in human superior temporal gyrus, suggesting that the model develops a distributed phonological code despite no explicit training on phonetic or phonemic targets. The ability to work with real speech is a major advance for cognitive models of HSR. (shrink)

Epistemic injustice is a harm done to a person in their capacity as an epistemic subject by undermining her capacity to engage in epistemic practices such as giving knowledge to others or making sense of one’s experiences. It has been argued that those who suffer from medical conditions are more vulnerable to epistemic injustice than the healthy. This paper claims that people with mental disorders are even more vulnerable to epistemic injustice than those with somatic illnesses. Two kinds of contributory (...) factors for epistemic injustice in psychiatric patients are outlined: global and specific. Some suggestions are made to counteract the effects of these contributory factors, for instance we suggest that physicians should participate in groups where the subjective experience of patients is explored, and learn to become more aware of their own unconscious prejudices towards psychiatric patients. This article presents a framework of ethical analysis for anticipatory evaluation of advanced biopreservation technologies and employs the framework illustratively in three domains. The framework features four clusters of general ethical considerations: (1) Producing Benefits, Minimizing Harms, Balancing Benefits, Risk, and Costs; (2) Justice, Fairness, Equity; (3) Respect for Autonomy; and (4) Transparency, Trustworthiness, and Public Trust.

We examine critically the interdependence between science and philosophy which Sklar asserts in Space, Time, and Spacetime. We find that such a view makes it difficult to criticize the ideas of science, like that of absolute space, on their own merits, without importing extraneous philosophical associations. It also impedes appreciation of the importance, and subtlety, of explanation in scientific theory. As a result, particular explanations, such as the one Newton offered of his bucket experiment, are dismissed facilely-- indeed, all geometric (...) explanation appears illegitimate--, and such general attitudes as conventionalism appear to lack rationale. This book is the fourth in a series of essay collections on defences in private law. It addresses defences to liability arising in equity. The essays range from those adopting a mainly doctrinal perspective to others that explore the law from a more philosophical perspective. Some essays concentrate on specific defences, while others are concerned with the links between defences, or with how defences relate to the structure of the law of equity generally. One aim of the book is to (...) shed light on equitable doctrines by analysing them through the lens of defences. The essays offer original contributions to this complex, important but neglected field of scholarly investigation. This book is about the three kinds of plots that run the lives ofpatients--subservience, bureaucratic delay and overpowering. It isalso about the three kinds of psychotherapy that attempt to deal withthese plots: objective psychiatry, which deals with the outsidesurface; subjective psychiatry, which deals with the inside; andnarrative psychiatry, which attempts to deal with both.

Apart from a few notable exceptions, the current retreat from Grand Theory has been accompanied by a reluctance to think about how we might theorize different forms of social formation. The present study began as an attempt to understand one such community form, the nation. However, in delineating an analytical method that allowed the theoretical space for exploring the ontological contradictions endemic to living as part of a national community, it became necessary to work comparatively across history and across different (...) social forms. In doing so, the article argues for a method that conceives of the various kinds of human community as formed in the changing and contradictory intersections of (diacritically distinguishable) levels of integration—from the most embodied ties of face-to-face reciprocity to the most abstract relations of strangers-in-association such as exemplified in the electronic communications of "information capitalism.". This article discusses ethical problems related to postsecondary–K-12 collaborative work involving instructional technologies. Technology related school-university collaboration in particular can give rise to some ethical dilemmas, due to the variety of skills, interests, and obligations of participating teachers, tech specialists, professors, and school administrators. Participants, in promoting narrow interests and concerns too immoderately, can lose sight of a learning-driven framework for decision making. Ethics are implicated, because student learning should be at the heart of the codes that guide all educators (...) in their professional behavior. This article begins by identifying potential advantages of using technology to enrich teacher education classes. The article then describes problems related to initiating access to K-12 classrooms and to negotiating a plan of action. The article seeks to reconcile the concerns of school administrators’and information technology officers’typical concerns with those of K-12- and university-based instructors. (shrink)

Digital platforms and application software have changed how people work in a range of industries. Empirical studies of the gig economy have raised concerns about new systems of algorithmic management exercised over workers and how these alter the structural conditions of their work. Drawing on the republican literature, we offer a theoretical account of algorithmic domination and a framework for understanding how it can be applied to ride hail and food delivery services in the on-demand economy. We argue that certain (...) algorithms can facilitate new relationships of domination by sustaining a socio-technical system in which the owners and managers of a company dominate workers. This analysis has implications for the growing use of algorithms throughout the gig economy and broader labor market. (shrink)

_John Dewey and Continental Philosophy_ provides a rich sampling of exchanges that could have taken place long ago between the traditions of American pragmatism and continental philosophy had the lines of communication been more open between Dewey and his European contemporaries. Since they were not, Paul Fairfield and thirteen of his colleagues seek to remedy the situation by bringing the philosophy of Dewey into conversation with several currents in continental philosophical thought, from post-Kantian idealism and the work of Friedrich (...) Nietzsche to twentieth-century phenomenology, hermeneutics, and poststructuralism. This unique volume includes discussions comparing and contrasting Dewey with the German philosophers G. W. F. Hegel, Friedrich Nietzsche, Martin Heidegger, and Hans-Georg Gadamer on such topics as phenomenology, naturalism, organicism, contextualism, and poetry. Others investigate a series of connections between Dewey and contemporary French philosophy, including the notions of subjectivity, education, and the critique of modernity in Michel Foucault; language and politics in Jacques Derrida; and the concept of experience in Gilles Deleuze. Also discussed is the question of whether we can identify traces of _Bildung_ in Dewey’s writings on education, and pragmatism’s complex relation to twentieth-century phenomenology and hermeneutics, including the problematic question of whether Heidegger was a pragmatist in any meaningful sense.
